These Terms of Service are an agreement between KingdomWeb and you. They explain the rules for using KingdomWeb’s products, services, and website. By using these services, you agree to follow these terms. If you do not agree, you cannot use the services. Your use of the services is also subject to other policies, including the Privacy Notice and Acceptable Use Policy. Additional terms may apply to certain services, such as the Domain Registration Agreement if you register a domain name. To use the services, you must be at least eighteen years old. Anyone under eighteen is not allowed to register or use the services. If you use the services on behalf of someone else, you confirm that you have permission to bind them to this agreement. You must provide accurate and up-to-date information when registering, including an email address that is different from your domain name. We will use your primary email address to contact you if needed. It is your responsibility to keep your contact information correct at all times. KingdomWeb is not responsible for service interruptions or expired domains caused by outdated information. You can update your details through the KingdomWeb Billing and Support Portal. Providing false information may result in account termination. In some cases, we may require government-issued ID and a credit card scan for verification. Failure to provide this may result in your order being denied. You are responsible for all activity on your account and for keeping your password and security details confidential. Any additional IP addresses you request may require justification under ARIN policies, and we may deny requests if justification is insufficient. Your data and the service are hosted in Canada unless stated otherwise. If you access the service from outside Canada, you agree that your information will be stored under Canadian law, not the laws of your location.
KingdomWeb will try to help you transfer your website to our platform as a courtesy, but we cannot guarantee that the transfer will be successful, possible, or completed within a certain time. Different hosting companies use different systems, and some store data in formats that are incompatible or proprietary, which can make transferring data very difficult or even impossible. In some cases, we may not be able to assist with transferring data from your old host. KingdomWeb is not responsible for any lost or missing data during a transfer to or from our services. You are fully responsible for backing up your data at all times.
All content provided through our services, except for user content, is owned by KingdomWeb or its licensors. This includes images from our website builder tools, designs, templates, text, graphics, videos, software, and other files. You are not allowed to copy, modify, distribute, reproduce, download, display, post, transmit, sell, or exploit any KingdomWeb content unless this agreement specifically allows it. You also may not reverse engineer or attempt to access the source code or trade secrets of any KingdomWeb content.
You are granted a limited license to use licensed images only in connection with our services. You cannot use these images for pornographic, defamatory, or illegal content, in ways that infringe on intellectual property rights, as trademarks or logos, or in any way that portrays people offensively. This includes linking them to adult content, tobacco advertising, political endorsements, illness, or criminal activity. Any unauthorized use of KingdomWeb content will immediately end your right to use our services and content. All rights not expressly granted to you remain with KingdomWeb and its licensors.
You can upload and share content such as text, photos, videos, and other materials through our services. This content, called User Content, includes anything posted by you or by visitors to your websites hosted with us. You are fully responsible for all User Content and any activities or transactions on your websites. By posting content, you confirm that you have the rights to share it and that it does not violate anyone else’s rights. To provide our services, you grant KingdomWeb a worldwide, royalty-free license to use, display, copy, modify, translate, and distribute your content, as well as make backups. We do not claim ownership of your content; it remains yours. KingdomWeb does not control or monitor User Content and is not responsible for it. However, if you violate this agreement, we may remove your content or websites and suspend or terminate your services without refund. We are not liable for any actions we take to enforce these rules. You must comply with all laws related to your content, websites, emails, and use of our services, including rules about exporting technical data. Our services are operated from Canada, and if you access them from another country, you do so at your own risk and must follow local laws. We do not provide services where prohibited by law.
If GDPR applies to you, you are the Data Controller and we are the Data Processor. You are responsible for meeting all legal obligations as a controller, including explaining how you use personal data, having a legal basis for sharing it with us, and ensuring you have permission to allow us to process it. Additional GDPR terms apply if you are a controller under GDPR. KingdomWeb may offer third-party products and services, which are subject to the provider’s terms. We are not responsible for their quality, availability, or accuracy, and you use them at your own risk. We may also act as a reseller or licensor of third-party products used with our services. We are not responsible for changes that make these products obsolete or affect performance. Any issues with these products are handled by the manufacturer, and your rights are limited to those provided by them. You may only use these products with our services and cannot copy, alter, reverse engineer, resell, or export them in violation of the law.
Our services may include links to third-party websites or content. We do not control or monitor these sites or content and are not responsible for them. If you choose to access them, you do so at your own risk, and their terms and policies will apply.
The services are subject to U.S. export control and sanctions laws. You cannot use the services to export or re-export software or technical data in violation of these laws. By using the services, you confirm that you are not located in or associated with any country under U.S. sanctions, such as Cuba, Iran, Syria, North Korea, or the Crimea region of Ukraine. You also confirm that you are not listed as a prohibited person by OFAC, involved in restricted activities like nuclear or weapons development, or otherwise barred under U.S. trade laws. KingdomWeb does not allow registration or use of services for domain names linked to sanctioned countries unless explicitly approved in writing. These obligations remain even after your account or this agreement ends.
You are responsible for keeping your account secure. This includes ensuring that any scripts or programs installed are safe and that directory permissions are properly set. Use strong passwords; weak passwords may lead to account suspension until corrected. We may audit passwords and notify you if changes are needed. The services and related systems are for authorized use only. KingdomWeb may monitor systems to ensure security and proper use, and by using the services, you consent to such monitoring. Any unauthorized access to third-party networks or systems can result in suspension, and we may require proof of authorization. Accounts that generate abuse reports or contain malicious content may be suspended or terminated if issues are not resolved. KingdomWeb may also move your account to a different data center without notice for legal, technical, or policy reasons. You must cooperate with KingdomWeb in providing services and supply any necessary equipment or software. If your failure to meet obligations delays our work, we are not responsible for those delays. You are responsible for making sure your content and websites are compatible with our systems, which may change over time. You are also responsible for backing up all your content and websites, as KingdomWeb does not guarantee backups and is not liable for any data loss.
You are responsible for keeping your payment information current and paying all invoices on time. Services must be paid for in advance, and payments will be applied to the oldest outstanding invoice first. Unless you cancel your services, billing will continue automatically using the payment method on file to avoid service interruptions. Service fees do not include taxes, which will be added to your invoice as a separate charge. All fees are non-refundable unless stated otherwise. Invoices must be paid within seven days of the due date. Failure to pay may result in suspension or termination of services, and access will not be restored until payment is received. If you do not pay, KingdomWeb may pursue collection costs, including legal and arbitration fees. New orders will not be processed if you have an outstanding balance.
For domain payments, you must notify KingdomWeb’s billing department after purchasing a domain. Renewal notices are provided as a courtesy, but KingdomWeb is not responsible for missed renewals. Domains are billed and renewed twenty-one days before their renewal date. Fraudulent or improper use of payment methods is prohibited and may be reported to law enforcement, credit agencies, and financial institutions. You have sixty days to dispute any charge. For questions about charges, contact our billing department. KingdomWeb complies with PCI security standards for collecting and processing customer billing data. However, you are responsible for the security of payment data on your own website, and KingdomWeb does not monitor or verify PCI compliance for user websites. KingdomWeb offers a sixty-day money-back guarantee for hosting services only. If you are not satisfied and cancel within sixty days of signing up, you will receive a full refund for hosting fees. This guarantee does not cover domain fees, administrative fees, custom software installation, setup fees, or any other additional services.
Refunds are not available for payments made by check or money order. If you use these methods, any credit will be applied to your hosting account instead of issuing a refund. If you purchased an account with a sixty-day money-back guarantee and cancel within the first sixty days, you can request a full refund of hosting fees by submitting a written request to the KingdomWeb Billing Team within sixty days of cancellation. This refund only applies to hosting fees and does not include domains, administrative fees, custom software installation fees, setup fees, or any additional services. Refund requests made after the sixty-day notice period will not be honored. Refunds are only available for first-time accounts. If you previously had an account, canceled, and signed up again, or opened a second account, you are not eligible for a refund. Any violation of this agreement voids your refund rights. Certain products and services are non-refundable, including domain names, SSL certificates, administrative fees, custom software installation fees, and some add-on services.
To cancel services, you must submit a written request through the online cancellation form. You are responsible for paying all fees accrued before cancellation. KingdomWeb may refund prepaid hosting fees for full months remaining after cancellation, minus setup fees, taxes, and any discounts, provided you are not in breach of this agreement. The cancellation form confirms your identity, ensures you understand that all files and emails will be permanently deleted, and helps prevent mistakes or fraud. Domain renewals occur twenty-one days before the renewal date. To cancel a domain, you must notify KingdomWeb at least thirty days before renewal. No refunds are given after a domain is renewed, and all domain registrations and renewals are final. KingdomWeb may terminate your services without notice if you fail to pay fees, violate this agreement, engage in harmful or abusive behavior, or for any lawful reason. In such cases, no refunds will be issued, and you must pay any outstanding fees. Upon termination, all user content, websites, and data will be permanently deleted.
Disk space must be used according to KingdomWeb’s Acceptable Use Policy and is limited to web files, active email, and website content only. Shared or reseller hosting cannot be used for general storage, media files, backups, or as an FTP host. KingdomWeb may review accounts for excessive use of CPU, disk space, or other resources and may terminate access, charge additional fees, or remove content if violations occur. Resource usage must be consistent with a shared hosting environment. Accounts with too many files, large databases, or excessive tables can harm server performance. If this happens, KingdomWeb may require you to reduce usage or may terminate your account without notice. Bandwidth for shared and reseller servers is not limited.
KingdomWeb guarantees 99.9% uptime for shared and reseller servers. If physical downtime falls below this, you may request one month of account credit within thirty days of the affected month. Planned maintenance is excluded, and approval of credits is at KingdomWeb’s discretion. Resellers must ensure their clients comply with this agreement and are responsible for supporting them. KingdomWeb does not provide support to reseller clients. Resellers are accountable for all content and actions under their accounts and must indemnify KingdomWeb against claims arising from their clients. Resellers handle all billing and technical support for their users. Shared accounts cannot be used to resell hosting; a reseller account is required.
KingdomWeb may change prices or charges at any time, with at least thirty days’ notice for annual or longer-term plans. It is your responsibility to review billing information regularly. Coupons and discounts apply only to first-time accounts and initial purchases, not renewals. Misuse of coupons may result in account suspension or termination.
KingdomWeb is not liable for indirect, incidental, or consequential damages, including lost profits or data. Our total liability is limited to the amount you paid for services in the three months before the claim, regardless of the number of claims. You agree to indemnify and hold KingdomWeb and its affiliates harmless from any claims, damages, or expenses arising from your use of the services, your breach of this agreement, or your actions. This obligation continues even after termination. By using KingdomWeb services, you agree to binding arbitration for any disputes. Arbitration will be handled by an arbitrator chosen by KingdomWeb, and all decisions are final. You are responsible for all costs related to arbitration.
KingdomWeb and the user are independent contractors. This agreement does not create a partnership, joint venture, or agency relationship, and neither party can bind the other or act on its behalf. Any disputes related to this agreement will be governed by the laws of Ontario, Canada. International sales law does not apply.
KingdomWeb is not responsible for any damages your business may suffer. We provide services “as is” without any warranties, including implied warranties of merchantability or fitness for a particular purpose. We are not liable for delays, delivery failures, data loss, or service interruptions.Using the services is at your own risk. Our backup service runs daily and keeps backups for 30 days, but this is only a courtesy for shared and reseller accounts and may be changed or discontinued at any time. You are responsible for maintaining your own backups and data. The services are provided “as is” and “as available.” We do not guarantee uninterrupted, error-free, or completely secure services, nor do we guarantee results or accuracy of information. We are not liable for any data transferred or stored through the services. These terms remain in effect even after termination.
KingdomWeb may disclose user information to law enforcement upon lawful request without notifying you. We fully cooperate with law enforcement agencies. This agreement, including referenced documents, is the entire agreement between you and KingdomWeb and replaces all prior discussions. Headings are for convenience only.
KingdomWeb may change this agreement or the services at any time. Significant changes will be posted on our website for at least 30 days, and the date of the last revision will be noted. Changes take effect when posted unless stated otherwise. By continuing to use the services, you agree to any changes. We may also modify or discontinue any part of the services at any time. If any part of this agreement is found invalid or unenforceable, the rest remains in effect. Failure to enforce any part of this agreement does not waive our rights. You cannot assign this agreement without our written consent, but KingdomWeb may assign its rights or use subcontractors without your consent. This agreement binds both parties and their permitted successors. Neither party is liable for delays or failures caused by events beyond their control, such as natural disasters, war, terrorism, labor disputes, or supply shortages, except for payment obligations.
This agreement does not give rights to anyone other than the parties involved, except for identified third-party beneficiaries who may enforce terms related to their products or services.
